ACE - Terms & Conditions

ACE is made and sold by Hive Hub Collective Pty Ltd (ABN 72 687 287 627), trading as Hive Hub Collective ("we", "us", "our"). By buying ACE, setting it up on a device, or letting a child use it, you agree to these terms. If you do not agree with them, please do not use ACE.

The short version

We have written this in plain English on purpose. Here is the whole thing in ten lines.

The full terms are below and they are what counts legally.

1What ACE is, and who it is for

ACE is a practice tool. A child types a word the way it sounds, ACE helps them find the real word, reads it and its meaning aloud, has them spell it out, then shows them how to form each letter so they can copy it onto paper.

ACE is built for primary-school-aged children and is designed to be set up by a parent, guardian or carer and used with their knowledge. It is not designed to be used by a child alone with no adult involved anywhere.

2ACE is a practice aid - not an educational program, and not medical or diagnostic

This section matters more than anything else here.

ACE is a practice aid made by a parent who has dyslexia, to help her own child want to practise. That is its whole story. It is not a formal educational product, a curriculum resource, a diagnostic tool, an assessment, a screening test, a clinical or therapeutic product, or a substitute for teaching or professional support.

If you have any concern about your child's reading, spelling, writing, speech or learning, speak to their teacher, your GP, or a qualified specialist such as a speech pathologist, educational psychologist or occupational therapist. Please do not wait on an app, including this one.

3Buying ACE

By buying and setting ACE up you confirm that:

You choose what names go into ACE. We suggest a first name or a nickname - ACE does not need anything more, and nothing more should be typed in.

5Badges, stickers, milestones and rewards

ACE gives badges and stickers for effort, and lets a grown-up set rewards that unlock at milestones. To be completely clear about what these are and are not:

6What you can do with ACE

We give you permission to use ACE on devices your household controls, for your own family's personal, non-commercial use, for as long as these terms are being followed. That permission is personal to you and cannot be transferred or resold.

8Words, meanings and sounds will sometimes be wrong

ACE contains a large dictionary and a plain-English meaning for most words in it, built from open, well-regarded language sources (see section 12). It is good, and it is not perfect.

ACE is supplied as a practice aid. Please do not rely on it as an authority for anything that matters - schoolwork being marked, anything published, or anything a decision rests on. Check it.

9Handwriting

The letter formation in ACE is designed for the child to watch and then copy onto paper with a real pen. It is a guide. Schools differ in the handwriting style they teach, and your child's school is the authority on what they should be doing, not ACE.

10Your device, your responsibility

11Availability and changes

ACE is provided as it is, when it is. We may change it, add to it, or stop offering it at any time. We do not promise it will always be available, always work, or always keep any particular feature. Updates we release for ACE are included in your purchase.

12Who owns what

ACE - its name, its design, its artwork, its character, its code and its text - belongs to Hive Hub Collective Pty Ltd. Buying ACE does not give you ownership of any of it.

Anything your child writes on paper is theirs. Obviously.

13Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right, warranty or remedy you have under the Australian Consumer Law or any other law that cannot be lawfully excluded or limited. In particular, if you are a consumer under the Australian Consumer Law, our goods and services come with guarantees that cannot be excluded, and you may be entitled to a remedy for a major failure and to compensation for reasonably foreseeable loss or damage.

Beyond those rights, and to the extent the law allows:

To the extent the law allows, we are not liable for a child's learning outcomes, their progress or results at school, or any decision made on the basis of using ACE - including decisions about a child's education, assessment, support or health.

We do not exclude liability for anything the law does not let us exclude, including liability for death or personal injury caused by our negligence, or for fraud.

14Stopping

You can stop using ACE at any time. To remove everything it has saved, use the device's option to clear the site's stored data, or delete the app. That is the whole process - there is no account to close, because there is no account.

We may end your permission to use ACE if these terms are being seriously or repeatedly broken.

15If ACE is ever supplied through an app store

If you get ACE from an app store, that store's own terms apply as well as these. Those terms cover things like payment, refunds and re-downloading. The store is not responsible for ACE itself - we are - and any question about ACE should come to us. Some stores require us to say that they are a third-party beneficiary of these terms and may enforce them; where that applies, they are and they may.

16Changes to these terms

We may update these terms. If we do, we will change the effective date at the top and make the current version available wherever ACE is offered. If a change is significant and we have a way to tell you, we will. Continuing to use ACE after a change means you accept the updated terms.

17Which law applies

These terms are governed by the laws of South Australia, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of South Australia.

18Odds and ends

If any part of these terms turns out to be unenforceable, that part is removed and the rest still stands. If we do not enforce something straight away, we have not given up the right to enforce it later. These terms, plus the Privacy Policy, are the whole agreement between us about ACE.
