1. ABOUT THESE TERMS

 

These Terms and Conditions (Terms) govern your registration for, attendance at, and participation in any workshop, bootcamp, training session, or educational event (Workshop) delivered by Hive Hub Collective Pty Ltd ABN 72 687 287 627 (we, us, our, Hive Hub Collective).

 

By registering for a Workshop, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not register.

 

These Terms are governed by the laws of South Australia, Australia. Nothing in these Terms limits any rights you have under the Australian Consumer Law (ACL), which cannot be excluded.

 

 

2. WORKSHOP DELIVERY

 

Our Workshops are currently delivered online only via video conferencing platforms including Zoom. We reserve the right to deliver future events in person. Where a Workshop transitions to in-person delivery, separate or updated terms may apply and will be communicated to you in advance.

 

Workshops are facilitated by Mia Steel and/or Kristen Werner, co-founders of Hive Hub Collective. We reserve the right to substitute facilitators with reasonable notice where required.

 

We reserve the right to reschedule, cancel, or modify Workshop content where reasonably necessary. We will notify you as soon as practicable. In the event of cancellation by us, you will receive a full refund or credit at your election.

 

 

3. REGISTRATION AND PAYMENT

 

Registration is confirmed upon receipt of payment in full. We accept payment via Stripe, PayPal, Klarna, and Afterpay, processed through our booking platform. Payment processing is subject to the terms and conditions of each respective payment provider.

 

Prices are displayed in Australian Dollars (AUD) inclusive of GST unless otherwise stated. Hive Hub Collective Pty Ltd is registered for GST purposes.

 

Buy now, pay later arrangements (including Klarna and Afterpay) are agreements between you and the payment provider. We are not party to those arrangements. Your obligation to pay the full purchase price is not conditional on your arrangement with any payment provider.

 

 

4. CANCELLATIONS AND REFUNDS

 

Due to the digital and time-sensitive nature of our Workshops, all sales are final.

 

We offer a cancellation window of 48 hours prior to the scheduled Workshop start time. If you notify us in writing before this window closes, you will receive a full refund. Cancellations received after this window are not eligible for a refund under any circumstances.

 

To cancel, you must contact us in writing at [email protected] before the cancellation window closes.

 

This refund policy does not affect your rights under the Australian Consumer Law. If a Workshop fails to be provided with due care and skill, or is not fit for purpose as represented, you may have additional rights under the ACL regardless of this policy.

 

We do not offer partial refunds, credits, or transfers to future events once the cancellation window has passed.

 

 

5. RECORDING OF SESSIONS

 

Our live Workshops are recorded for the purpose of providing replay access to registered participants. By registering for and attending a Workshop, you acknowledge and consent to the session being recorded.

 

Replay access is provided to registered participants for personal, non-commercial, educational use only. Access periods will be communicated at the time of registration.

 

If you appear on camera or participate verbally during a live session, your likeness and voice will be captured in the recording. If you do not wish to appear on camera, you may participate with your camera disabled. We are not responsible for any incidental capture of your likeness if you choose to enable your camera.

 

Recordings remain the intellectual property of Hive Hub Collective Pty Ltd. You may not download, share, distribute, or reproduce recordings in any form.

 

 

6. PHOTO, VIDEO AND LIKENESS RELEASE

 

If you attend a live online session and enable your camera, or participate verbally, you grant Hive Hub Collective Pty Ltd and its authorised representatives the right to use your name, likeness, voice, and image as captured during the session for the following purposes:

 

- Promotional and marketing materials including social media, website, email marketing, and advertising

- Educational and instructional content

- Internal and external training materials

 

This right is granted on a perpetual, royalty-free, non-exclusive basis. You will not receive compensation for any such use.

 

If you do not wish to grant this right, you must participate with your camera disabled and avoid verbal participation that would identify you. Participation in the Workshop does not itself constitute consent to marketing use; only on-camera or verbal participation triggers this clause.

 

For any future in-person events, a separate written release may be required at the time of attendance.

 

 

7. THIRD-PARTY TOOLS AND PLATFORMS

 

Our Workshops provide education about artificial intelligence tools and platforms, including but not limited to Claude (Anthropic), ChatGPT (OpenAI), and various connector, automation, and workflow platforms (Platforms).

 

We recommend and demonstrate specific Platforms for educational purposes only. Our recommendations do not constitute endorsement, and you are solely responsible for evaluating whether any Platform is suitable for your business and personal circumstances.

 

Your use of any Platform is governed entirely by that Platform's own terms of service, privacy policy, acceptable use policy, and any other agreements between you and that Platform. We are not a party to those agreements.

 

You must conduct your own due diligence before using any Platform recommended or discussed in our Workshops. This includes, but is not limited to:

 

- Reviewing the Platform's terms of service and privacy policy

- Assessing whether the Platform meets your data security and privacy requirements

- Understanding how the Platform stores, processes, and uses your data and the data of your clients or customers

- Ensuring your use of the Platform complies with all applicable laws, including the Privacy Act 1988 (Cth) and Australian Privacy Principles where applicable

- Understanding any subscription, licensing, or usage costs associated with the Platform

 

Participants bring their own devices and are responsible for setting up their own accounts on any Platform during or following a Workshop. We do not access, manage, or take any responsibility for any account you create or maintain on a third-party Platform.

 

 

8. NO LIABILITY FOR THIRD-PARTY TOOLS

 

To the maximum extent permitted by law, Hive Hub Collective Pty Ltd expressly excludes all liability for any loss, damage, harm, expense, or claim arising from or in connection with:

 

- Your use of any third-party Platform, tool, software, or service recommended, discussed, or demonstrated during a Workshop

- Any breach of data, privacy incident, security vulnerability, or unauthorised access occurring on or through any third-party Platform

- Any incompatibility between a Platform and your devices, systems, software, or existing business infrastructure

- Any changes to a Platform's pricing, features, availability, or terms of service

- Any financial loss, business loss, or consequential damage arising from your implementation of AI tools following a Workshop

- Any error, inaccuracy, or omission in content provided by any third-party Platform

 

You acknowledge that AI technology is evolving rapidly and that information provided during a Workshop may become outdated. It is your responsibility to verify the current accuracy of any information before acting on it in your business.

 

Nothing in this clause limits any rights you have under the Australian Consumer Law.

 

 

9. EDUCATIONAL PURPOSE AND NO PROFESSIONAL ADVICE

 

All content delivered in our Workshops is provided for general educational and informational purposes only. It does not constitute legal, financial, accounting, tax, technical, or professional advice of any kind.

 

You should seek independent professional advice before making any business, legal, financial, or technical decision based on information provided in a Workshop.

 

We make no representation or warranty that the strategies, systems, or approaches discussed in our Workshops will produce any particular result for your business. Results will vary depending on your individual circumstances, effort, business type, and external factors outside our control.

 

 

10. PARTICIPANT RESPONSIBILITIES

 

By attending a Workshop, you agree to:

 

- Participate respectfully and constructively

- Not record, screenshot, or capture Workshop content beyond what is provided to you by us as an authorised participant

- Not share, distribute, reproduce, or resell Workshop content, recordings, materials, or methodologies to any third party

- Take full responsibility for your own use of any AI tools or Platforms following the Workshop

- Ensure that your use of AI tools complies with all applicable laws and does not infringe the rights of any third party

- Not use Workshop content to develop or deliver competing educational products or services without our prior written consent

 

 

11. INTELLECTUAL PROPERTY

 

All Workshop content, materials, recordings, frameworks, methodologies, slides, documents, and resources are the exclusive intellectual property of Hive Hub Collective Pty Ltd. All rights are reserved.

 

Your registration grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use Workshop materials for your own personal, non-commercial, educational purposes only.

 

This licence does not permit you to copy, reproduce, modify, adapt, translate, distribute, publicly display, sell, or create derivative works from any Workshop materials without our prior written consent.

 

Where we share third-party resources, those remain the intellectual property of their respective owners.

 

 

12. CONFIDENTIALITY

 

Workshop materials, including frameworks, methodologies, processes, systems, and proprietary content, are confidential. You agree not to disclose, reproduce, or share this information outside the Workshop for a period of five (5) years from your date of registration. This obligation survives completion, cancellation, or termination of your access.

 

 

13. LIMITATION OF LIABILITY

 

To the maximum extent permitted by the Australian Consumer Law and other applicable law, our liability to you for any loss or damage arising from a Workshop or these Terms is limited to the amount you paid for the relevant Workshop.

 

We exclude all liability for indirect, consequential, special, incidental, or punitive loss or damage including loss of profits, loss of revenue, loss of data, loss of opportunity, or reputational harm.

 

Where the Australian Consumer Law applies and cannot be excluded, our liability is limited as permitted under section 64A of the Competition and Consumer Act 2010 (Cth), including limiting our liability to re-supplying the educational services.

 

 

14. VIOLATIONS AND ENFORCEMENT

 

Breach of these Terms may result in:

 

- Immediate removal from the Workshop without refund

- Termination of access to recordings and materials without refund

- Legal action to protect our intellectual property and business interests

- A claim for damages, injunctive relief, or other remedies available under Australian law

 

 

15. CHANGES TO THESE TERMS

 

We reserve the right to update these Terms from time to time. Material changes will be communicated to registered participants. Continued participation constitutes acceptance of updated Terms.
